Terms of Service
Welcome to Shamed. These Terms of Service ("Terms") govern your use of the Shamed mobile application ("App") and related services. By using the App, you agree to these Terms.
1. Eligibility
You must be at least 13 years old to use this App. If you are under 18, you must have permission from a parent or guardian. By using the App, you represent that you meet these requirements.
2. Account Registration
- You may sign in using Google Sign-In. You are responsible for maintaining the security of your account credentials.
- You agree to provide accurate information and keep your account information current.
- You are responsible for all activity that occurs under your account.
3. Service Description
Shamed is a social accountability app that helps users track and reduce screen time. Features include:
- Screen time tracking: Monitoring of device and app usage statistics.
- Groups: Create or join groups to track screen time together.
- Leaderboards: Compare usage statistics with group members.
- Wall posts: Share messages and reactions within groups.
- Credits: In-app currency for creating groups.
4. Device Permissions
- Usage Access (Android): Required to collect screen time and app usage data. You can revoke this permission at any time in your device settings, but core functionality will be limited.
- Notifications: Optional permission to receive updates about group activity and reminders.
5. Groups and Social Features
- Groups are created by users and may have multiple members.
- Your display name and usage statistics are made visible to other members of your groups until you .
- Your leaderboard position is visible to group members.
- Wall posts and reactions you create are visible to group members.
- Group administrators can remove members and delete posts.
- When a group ends, usage data is retained for historical leaderboard purposes. If you leave or are removed from a group, your data in that group is deleted (if the group is currently active) or anonymized (if the group has ended).
6. User Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of these Terms.
- Post offensive, harmful, threatening, or inappropriate content.
- Harass, bully, or abuse other users.
- Attempt to manipulate or falsify usage data.
- Interfere with or disrupt the App or its servers.
- Attempt to gain unauthorized access to any part of the App.
- Use automated systems or bots to access the App.
- Impersonate another person or entity.
7. Confidentiality of User Information
You agree to keep all information you obtain about other users through the App confidential. This includes, but is not limited to:
- Screen time and usage statistics of other users.
- Leaderboard rankings and positions.
- Wall posts and reactions.
- Display names and any other personal information.
You are strictly prohibited from sharing, distributing, publishing, or disclosing any information about other users obtained through the App to any third party or on any platform outside of the App, without the express written consent of the affected user(s). Violation of this clause may result in immediate termination of your account and may expose you to legal liability.
8. User-Generated Content
- You retain ownership of content you create (wall posts, reactions).
- By posting content, you grant Shamed a license to display that content within the App to other group members.
- We reserve the right to remove content that violates these Terms.
- Group administrators may delete posts within their groups.
9. In-App Purchases
- The App offers credits that can be purchased and used to create groups.
- Purchases are processed through Google Play and are subject to their terms.
- All purchases are final and non-refundable except as required by law.
- Credits have no cash value and cannot be exchanged for money.
- We reserve the right to modify credit pricing and availability.
10. Intellectual Property
- The App, including its design, features, and content (excluding user-generated content), is owned by Shamed.
- You may not copy, modify, distribute, or reverse engineer any part of the App.
- The Shamed name and logo are trademarks and may not be used without permission.
11. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
12. Disclaimers
- The App is provided "as is" without warranties of any kind.
- We do not guarantee the accuracy of usage statistics, which depend on device permissions and operating system limitations.
- We are not responsible for user-generated content or interactions between users.
- We do not guarantee uninterrupted or error-free service.
13. Limitation of Liability
To the maximum extent permitted by law, Shamed shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Shamed and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App, violation of these Terms, or violation of any rights of another.
15. Termination
- You may stop using the App and delete your account at any time through the Privacy Settings.
- We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion.
- Upon termination, your right to use the App ceases immediately.
16. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by other means. Continued use of the App after changes constitutes acceptance of the new Terms.
17. Governing Law
These Terms are governed by the laws of the jurisdiction in which Shamed operates, without regard to conflict of law principles.
18. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall first be attempted to be resolved through informal negotiation. If resolution cannot be reached, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
